Wakil Ketua Bapemperda DPRD Provinsi Bengkulu H. Andrian Wahyudi dalam uraianya menyampaikan, Perda Provinsi Bengkulu Nomor 07 Tahun 1993, tentang Badan Musyawarah Adat tidak mampu lagi mengakomodir kepentingan hukum dan kepentingan sosial masyarakat.

DPRD beralasan, konsiderans yang dijadikan landasan yuridis formil dari Perda Nomor 07 tahun 1993 ini tidak dapat diberlakukan dan sudah tidak mempunyai kekuatan hukum mengikat.

“Kami berpendapat bahwa perda tentang Badan Musyawarah Adat ini sudah tidak mampu lagi mengakomodair seluruh kepentingan hukum dan kepentingan sosial pada lembaga adat atau badan musyawarah adat di segala tingkatan pada saat ini,” sebut Andrian.

Untuk itu, DPRD meminta perda ini dicabut dan dibentuk peraturan daerah baru yang sesuai dengan perkembangan atau kondisi Bengkulu terkini.

Ini juga bertujuan agar lembaga adat mampu menghimpun dan mengakomodir pelestarian nilai-nilai seni, budaya, hukum adat, serta menjadi wadah bagi seluruh lembaga adat yang ada di sembilan kabupaten dan satu kota dalam wilayah provinsi.

Sementara terkait Raperda tentang Bantuan Hukum bertujuan untuk membantu masyarakat dalam memperoleh keadilan saat dihadapkan dalam sebuah perakara.

Dengan adanya kewenang pemerintah daerah maka daerah dapat mengalokasikan anggaran penyelenggara bantuan hukum dalam anggaran pendapatan dan belanja daerah, yang diatur dalam peraturan pemerintah nomor 42 tahun 2013 tentang syarat dan tata cara pemberian bantuan hukum dan penyaluran dana bantuan hukum.
